DEFINITIONS


In this Agreement, "Ebru Evrim Ltd" is Ebru Evrim studio exclusive to the Harrogate location.
"You/Your" means the Ebru Evrim membership cardholder and person whose name and signature appear on this document.

GENERAL AGREEMENT

  • You are entering into an Agreement with Ebru Evrim Ltd. The terms of the Agreement differ depending on the membership plan or pay as you go services. Please read carefully.
  • You cannot transfer this agreement to anyone else.
  • You agree not to conduct any kind of commercial or business activity and will not act as a teacher for any other member.
  • This agreement is governed by English Law
  • You are responsible for informing Ebru Evrim Ltd of any changes to your personal details and contact information.
  • At the point of signing up to an Ebru Evrim Ltd membership package you must agree to the terms and conditions and are prompted for your data signature and electronic date stamp, confirming acceptance of the aforementioned.

MEMBERSHIP PACKAGES (Rolling Credits – Core, Active and Pro Packages Only)

  • Ebru Evrim Ltd offers a variety of membership packages and pay as you go options to cater to different needs. When you sign up for a credit-based membership, you will receive additional credits, except for the Unlimited membership option and “Pay as you go” options.

  • At the time of purchase, Ebru Evrim Ltd will collect the first month's payment or the full payment through Debit or Credit card.

  • All memberships are designed as rolling month contracts, giving you flexibility.

  • The rolling-contract membership offers the flexibility to choose between peak and off-peak hours for classes. Please note that different pricing structures apply for off-peak and peak classes, depending on the class type.

  • Off-peak hours are defined as 9 am-4 pm on weekdays and after 11 am on weekends. Peak hours are defined as 7 am-8 am and 5 pm-8 pm on weekdays, as well as 7 am-10 am on weekends.

  • If you choose a rolling credit-based membership, it operates on a credit system. You will receive free credits that can be used to pay for classes, workshops, retreats, and Ebru Evrim products. Any remaining balance of credits at the end of the month will roll over to the following month.

  • Please note that balances for credit-based memberships are non-refundable due to the inclusion of free credits. However, any leftover balance can be converted into an Ebru Evrim gift card, which can be used for future payments against Ebru Evrim Ltd products.

  • As the discretion of Ebru Evrim Ltd, we may request the member to convert balances into an Ebru Evrim Gift Card to avoid the accumulation of large balances on account. Ebru Evrim Ltd reserves the right to suspend accounts for “non usage”.

  • Depending on the membership package you choose, you will receive tailored benefits specific to that membership package. These may include, but not exclusive, discounts on activewear, guest class pass and other discounted prices to Ebru Evrim products and services.

  • Ebru Evrim Ltd reserves the right to make changes or modifications to the membership packages at anytime. This includes adjustments to prices, discounts, or the number of classes offered. Rest assured, you will be given 30 days notice period of any changes.

  • We will inform you at least 30 days in advance of any upcoming changes through email. The notice will include the effective date of these changes.
     
  • Only the person named on the membership can use the rights and privileges of the membership at any time.

UNLIMITED OFF-PEAK MEMBERSHIP PACKAGES

  • Unlimited membership is as rolling month contracts, giving you flexibility.

  • You are entitled to join 30 off-peak classes in a month.

  • Please note that different pricing structures apply for off-peak and peak classes, depending on the class type.

  • Off-peak hours are defined as 9 am-4 pm on weekdays and after 11 am on weekends.

  • On the unlimited package you will receive tailored benefits specific to that membership package. These may include, but not exclusive, discounts on activewear, 2 guest class pass and other discounted prices to Ebru Evrim products and services.

  • Ebru Evrim Ltd reserves the right to make changes or modifications to the membership packages at anytime. This includes adjustments to prices, discounts, or the number of classes offered. Rest assured, you will be given 30 days notice period of any changes.

  • We will inform you at least 30 days in advance of any upcoming changes through email. The notice will include the effective date of these changes.
     
  • Only the person named on the membership can use the rights and privileges of the membership at any time.

MEMBERSHIP CANCELLATION

  • Our studio values the commitment of our members and understands that circumstances may change. If you need to cancel your membership, we kindly request that you provide a notice of cancellation at least 30 days in advance of your next monthly membership instalment. This allows us to make all necessary administration and system updates and allows us time to offer your spot to other interested individuals.

  • Please note that any cancellation requests received less than one month in advance may still be subject to the full monthly fee. We appreciate your understanding and cooperation.

  • To cancel your membership, please contact our studio reception or send us an email at harrogate@ebruevrim.com. Our team will guide you through the cancellation process and answer any questions you may have.

  • We reserve the right to amend or modify the terms of this cancellation period clause at our discretion. Any changes will be communicated to you 30 days in advance.

PAYMENT TERMS

  • In order to join any Class, payment must be made prior to attending.

  • The prices for Memberships and packages can be found at the Studio, on our Website, and our mobile app. These prices may be subject to change at our discretion. VAT is included in our prices.

  • Payments for individual Classes and Memberships can be made online through the Website or our mobile app using the credit and debit cards listed on the payment pages.

  • For Monthly Subscriptions, the start date is the date of purchase. Regular payments will be charged to the Member's credit or debit card on the agreed-upon day and at monthly intervals thereafter until the Membership expires, is cancelled under our cancellation policy or an alternative date is agreed upon with the Member at the sole discretion of Ebru Evrim Ltd.

  • If there are any lapses in Membership payment, including the non-payment of any fees owed, an administration fee may be charged at our discretion upon reapplication for Membership. Our payment system will try 3 times after the first payment failure at which point your account will be automatically subject to the terms of our cancellation policy.

  • Unless stated otherwise in these Terms and Conditions, payments for Classes, Monthly Subscription fees, and gift certificates are non-refundable and non-transferable. Any refunds granted will be solely at our discretion unless there are statutory rights of cancellation.

TEMPORARY SUSPENSION OF ACCOUNT

Memberships can be put on hold under certain circumstances, including receipt of a doctor's note confirming the member's inability to participate in the chosen classes, a family emergency, prolonged illness, or financial hardship for a month.

BOOKING

 

  • Booking is available 7 days in advance of the class.

  • Classes can be booked online by all Members and pay as you go clients in advance via our personalised app or the Website. No bookings will be taken via email.

  • Class sizes are limited and so all bookings are based on first come first serve basis so please make sure you book in advance to avoid disappointment.

  • The booking cancellation window is as follows:
    •  All Group Classes must be cancelled online via our online app or website, 24 hours before the start of a Class or this will be treated as a ‘no show’ and the full fee of the class will be charged.
    • Workshops must be cancelled 1 week before the date for the Workshop or this will be treated as a ‘no show’ and the full fee will be charged.
    • The method for receipt of cancellation is online via our mobile app or our Website. We will not accept cancellations via email or social media. Bookings cancelled outside of the cancellation window are ‘no shows’ and will be charged in full.

  • We may cancel a Class booked by you at any time before the time and date of that Class in the following circumstances:

    • The required minimum number (if any) for the Class have not booked for that Class;
    • The required instructor and/or equipment is not available.

If we cancel a Class, in such circumstances, we will refund to you the fee you have paid for that Class

  • If a Class is fully booked, you can add yourself to the online ‘waitlist’. Once you are on the ‘waitlist’, as places come up in a Class, you will be automatically moved from the ‘waitlist’ to a reserved space in the Class by reference to your position on the waitlist. At this point normal booking terms apply.

 

  • ‘Waitlist’ places are automatically moved into a Class up to 1 hour before the start of a Class but not after that time, so if you are on a ‘waitlist’ you should be prepared to cancel your place on the online ‘waitlist’ anytime up to 1 hour before the start of a Class if you do not want to be added into the Class.

 

  • 24 hours before the start of a Class, once cancellations have been made, some spaces may become available for Members to book online direct and not onto the ‘waitlist’ so it is a good time to check in and see if there are some pre-booked spaces free to reserve. These will be handed out on a first come first serve basis and we cannot guarantee a place.

 

  • If a Class is booked online you must sign in at reception at the Studio at least 5 minutes before the Class start time. Failure to do this may be treated as a ‘no show’ and your space may be given to someone else.

 

  • In the case of a ‘no show’ for failure to turn up 5 minutes before the class starts, payment will still be taken in full for the Class.

 

  • If you have 2 ‘no shows’ or ‘late cancels’ in any two week period, we may suspend your booking rights for one month.  For "Reformer Pilates” classes we allow only 1 cancelation per month due to high demand and low capacity for these classes.

  • If you constantly cancel classes and do not communicate with us about reasons for cancelations, we reserve the right to remove you from all future Classes you may have booked into and give your place to our "stand by list” clients.

 

  • We will use all reasonable endeavours to start each Class at the scheduled start time but the start may be delayed by the overrun of an earlier Class or by other circumstances. If the delay to the start is at least 20 minutes you may cancel the Class and we will refund your fee or, if the Class was booked as part of a package, allow you to rebook the Class.

 

  • Anyone arriving late will not be admitted into a Class.

 

  • Details of Class times at the Studio may vary from time to time including cancellations of individual Classes. Class times are published by us and will be available on the mobile app and Website.

USE OF FACILITIES WITH CHILDREN/CHILDREN MEMBERSHIPS/FAMILY CLASSES/MOTHER-BABY CLASSES

  • All minors under the age of 16 must be accompanied by an adult to the Classes except Teenage Yoga/Pilates classes

  • Please note Kids Yoga/Pilates, Baby massage and Baby yoga are stand-alone courses and are not included in membership.

  • Please find instructions available at The Studio how to make booking for children classes.Children under the age of 16 may only use a Studio and attend Classes if accompanied by an adult and if prior approval has been given by the parent consent form in writing by email.

  • Children of any age may not enter changing rooms or other areas unless they are accompanied by an adult.

FITNESS AND HEALTH

  • You will be asked to fill out a questionnaire as part of your Membership application in which you must state clearly any health issues/conditions and provide a release form from your medical adviser if these issues/conditions prevent you from doing any form of exercise/Classes.

  • It is a Member’s responsibility to ensure that their physical condition is appropriate for participating in Classes and to ensure that they correctly operate or use any facilities and/or equipment provided by us including the adjustment of levels or settings on any equipment. 

  • Some classes involve intensive exercise. You must familiarise yourself with what each Class involves before assessing whether you are fit to participate in a Class. You should refer to the website and personalised app or speak to a member of staff for further information.

  • You are advised by us and should NOT undertake any physical activities like our in person/on demand classes without first seeking medical advice. We are not liable for any injuries accrued during our online or on demand classes taken by you at home, you are taking these at your own risk. Please make sure to read all class descriptions and If you have any concerns over your physical condition please seek medical advise. We reserve the right to refuse access to any Member if, in our absolute discretion, we consider that your health may be endangered by the use of our facilities.

  • If you suffer from low/high blood pressure and/or cardiac irregularities you should not attend any Class unless you have written permission from your doctor. 

  • You should not use our facilities if you have any infectious or contagious illness, disease or other ailment or are suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health, safety, comfort or physical condition of the other Members. If there is any doubt, you should consult your doctor and must notify us of any circumstances affecting your health which may be exacerbated through continued use of a Studio.

  • You are required to follow the instructions of the instructor at all times.

  • You must inform your instructor if you suffer any injuries or conditions which may affect your ability to participate in our Classes after you have been admitted as a Member.

  • We provide personalized fitness assessments to ensure that you and your guests are in good physical condition and capable of participating in exercises without risking your health, safety, comfort, or overall physical well-being. If you require any assistance, please inform the studio reception, and we will gladly accommodate your requirements within reason.

  • We reserve the right to exclude you from a Class if it becomes apparent during that Class that you are suffering from any kind of health or physical issue that may present a danger to yourself or to others.

  • You must not attend any Class if you are under the influence of alcohol, illegal drugs or misuse of prescription drugs.

  • If you are pregnant you must provide a written form from your doctor/midwife confirming that you allowed to take pregnancy classes such as pregnancy yoga, pregnancy Pilates and meditation/restorative classes.

  


  • If you are post-natal you must have successfully had your six/eight week check (10-12 weeks for a caesarean) with your GP before starting classes, to avoid risk of injuries.  It is also recommended that you wait until all lochia (bleeding) has completely stopped.

PERSONAL BELONGINGS AND SAFETY

  • We and our employees are not be liable for any loss, damage or theft of any property belonging to, or brought on to or left outside of the Studio by you or your guests. All personal items must be securely stored in lockers in changing rooms. We do not accept any responsibility for any items left unattended anywhere on our premises. 

 


  • Members are requested to wear a form of clothing appropriate to the Classes they attend. Footwear should be removed in the changing area/changing room before entering all yoga/pilates studios. Suitable socks must be worn for Reformer Classes.
     
  • In the interests of safety and hygiene, no crockery, glass or food are permitted in the changing rooms or any studios.

  • Members must use the main entrance to the Studio when entering or leaving. 

  • Fire exits, which are clearly marked, are there in the interests of safety and Members must not interfere with or obstruct these doors for any reason.

  • In the event of a fire, Members are asked to make their way to the nearest available exit and assemble at a safe distance from the Centre so that we may take a roll-call of all those in the Centre when the alarm sounded.

GUEST PASSES

 

  • Certain membership plans include free monthly guest passes. Members eligible for this benefit can request their passes at the Harrogate studio reception.

  • Guest passes are only available to individuals aged 18 years and above. Ebru Evrim Ltd will collect basic contact information at the time of booking.

  • If a Guest uses the studio, they cannot use it again at another time as a guest.

  • Guests must adhere to all studio rules and guidelines while using their guest pass.

  • Ebru Evrim Ltd reserves the right to refuse a guest pass at any time.

GIFT CARDS

  • The Gift Card can not be exchanged or redeemed for a monetary value.

  • Gift Cards can be exchanged for Ebru Evrim products and services, online at ebruevrim.com and in Ebru Evrim studios.

  • Gift Cards may not be used for mail order purchases.

  • The balance on the Gift Card may be used for full or part payment. The gift card is valid for 6 months.

  • No change will be given but any unused balance will remain on the Gift Card and may be applied to future purchases.

  • Promotional offers may not apply to Gift Card purchases.

  • No VAT is charged when buying the Gift Card, but purchases paid for using the Gift Card are subject to VAT.

  • Keep the Gift Card safe and treat it as cash. We will not accept any liability for lost, stolen or damaged Gift Cards or for any remaining balance on the Gift Card.

  • If you have made an Online payment with a Gift Card in whole or part and any item paid for using the Gift Card is accepted for return the amount owing will be added to the original Gift Card.

  • For general information about returns and exchanges please contact reception.

  • We may withdraw or cancel the Gift Card and require an alternative form of payment if we suspect that the Gift Card may have been stolen or fraudulently used. Further action may also be taken.

  • We reserve the right to amend or supplement these conditions or discontinue the Gift Card at any time.

  • Gift cards balance can be checked in the reception at the Studio.

LIABILITY WAIVER

  • By becoming a member, individuals acknowledge and accept any risks associated with participating in yoga and Pilates classes. Members agree to release the studio, its instructors, and staff from any liability for injuries or damages that may occur during classes or while using the studio facilities.
