TERMS AND CONDITIONS
Cardholder Terms and Conditions
In this Agreement, "Studio" is Skipton studio of Ebru Evrim Ltd. "I" means the Full Works cardholder and person whose name and signature appear on this document. I am responsible for updating address and contact information.
If I am a ‘pay as you go’ client and I ‘early cancel’ i.e. at least 24 hours prior to the class, I will receive a full refund to my Mindbody account, but if I am a ‘pay as you go’ client and I ‘late cancel’ i.e. less than 24 hours prior to the class, I will be charged 50% of the class fee and the remaining 50% will be credited to my account. If I have a membership and I ‘early cancel’ i.e. at least 24 hours prior to the class, I will not be charged. If I have a membership and I ‘late cancel’ i.e. less than 24 hours prior to the class or do not show up, I will be charged £5. Cancelling 1 2 1 sessions: If I ‘early cancel’ i.e. at least 24 hours prior to the class, I will receive a full refund to my Mindbody account. If I ‘late cancel’ i.e. less than 24 hours prior to the class, I will be charged the full amount of the session. I understand that the studio will be sympathetic to genuine reasons for non-attendance if I contact the studio directly should an emergency have arises.
COOLING OFF PERIOD
If I wished to cancel this Agreement, I may do so by emailing written notice to the Studio. The notice must say that I do not wish to be bound by the Agreement, and must be delivered before midnight on the fourteenth day from the Agreement date. The Studio will refund anything paid, but the refunded amount will be less an amount to cover processing costs. Refunds will be made no later than 14 days after the day on which the Studio was informed about the decision to cancel, and Full Works card was returned. The refund will be made using the payment method I used for the initial transaction; there are no cash refunds.
This Agreement is a legally binding obligation for which I am financially responsible. If I have a top-up card, I acknowledge that the credit is not refundable or transferable under any circumstances. If I have a direct debit card, it will automatically renew after the term ends and I will continue to be billed according to the regular billing schedule unless I provide notice of cancellation. A term membership has an early cancellation fee. I agree not to conduct any kind of commercial or business activity as a Full Works cardholder, and will not act as a teacher for any Full Works cardholder. I understand they are responsible for updating address and contact information.
After right to cancel period noted earlier (if any), I may cancel membership by giving notice by filling out a cancellation form at the Studio. The notice will be effective on the last day of the month which is at least 30 days from the date of notice, and I will be required to pay all fees up until that date and any outstanding fees for other services already supplied, regardless of whether or not the card is used after the date of notice. If collection or legal services are needed to collect any unpaid amount, I am responsible for all costs of collection, including solicitor’s fees of Ebru Evrim Ltd. If I die or become totally or permanently disabled, upon reasonable written notice to the Studio with proof of the death or disability, either I or my estate may cancel this Agreement and receive a prorated refund of the unused portion of membership fees incurred.
I have the right to freeze direct debit cards like Full Works Silver for a minimum of one month and up to three months per year, during which time I will not be charged. I must provide written notice at least five days in advance of my next billing cycle. I will incur a processing charge of £3 for each frozen month. For annual direct debit cards like Gold or Silver, the term will be extended for a period equal to the freeze period. A card cannot be cancelled during a freeze period. Cradholder freeze can be used once a year only, and is intended to cover special circumstances. Top-up credit like on the Classic card has to be used within six months, or is claimed by the Studio and the card closed.
FACILITIES AND SERVICES
The Studio reserves the right at any time to delete, discontinue, repair or replace the facility equipment without any effect on this Agreement. The Studio may be closed for up to two weeks each year for maintenance purposes.
From time to time, and but not before a year of membership at original price paid has expired, the Studio may need to increase the price of cards. The Studio will give at least 30 days’ notice of any upcoming price increase, and will make it very clear when the price increase will take effect and how much each card will cost after the increase. During this period, I will have the usual right to terminate cards in accordance with my terms and conditions. If I do not terminate my card by the date given to me in the notice then the price of the card will be increased in accordance with the notice provided.
All Full Works members must be a minimum 16 years of age. All minors under the age of 16 must be accompanied by a parent or legal guardian who must sign the Studio questionnaire. Accompanied minimum age accepted may vary as in the case of kid's yoga and is at the discretion of the Studio.
LIMITATION OF LIABILITY
I agree that, except for any legal responsibility that the Studio cannot exclude in law (such as for death or personal injury), Studio is not legally responsible for any: (i) losses that (a) were not foreseeable to me or the Studio when the contract was formed or (b) were not caused by any breach on the part of Studio; (ii) business losses; or (iii) losses to non-consumers.
FULL WORKS CARD
If I lose or misplace the card, I need to contact the Studio to order and collect a new one, and I understand I will be charged for the replacement card at the then current rate.
This is the whole Agreement between the parties with respect to the Full Works Cradholder Terms and Conditions and supersedes any prior understandings or agreements of the parties whether written or oral, express or implied. With the exception of pricing changes from time-to-time as noted above, this Agreement may not be amended or modified except in writing signed by both parties.
For purposes of this payment authorization, the term "I" refers to the new Cradholder whose name appears above as the primary account holder and whose signature appears below. "You" refers to the financial institution where I hold an account. I authorise you to pay Cradholder fees on my behalf to Studio (or its designee) in the amount of the Full Works card I have selected (inclusive of VAT at 20%). These payments will continue until I submit a written notice of cancellation to the Studio as instructed in this agreement. I agree I am bound by the cardholder payment terms and unpaid account balance due upon cancellation. I agree that you will be fully protected in honouring these direct debits and that your treatment of them and rights in respect to them are the same as if personally signed by me.
I understand that if I terminate the agreement or stop the automatic payment arrangement in a manner not described in the agreement, I may be liable to the Studio for damages for breach of contract.
STUDIO USAGE TERMS & CONDITIONS DEFINITIONS
In this Agreement, "Studio" is Ebru Evrim Ltd, which is the "Studio" at which the agreement is signed. "I" means the person whose name and signature appear on this Agreement.
PHYSICAL CONDITION AND NO MEDICAL ADVICE
I confirm that I am in good physical condition and have no medical reason or impairment that would prevent me from my intended use of Ebru Evrim facilities. I understand and acknowledge that the Studio will not and cannot provide me with any medical advice. If I have any health or medical concerns now or after joining, I will discuss them with their doctor before using the facilities.
I understand I may be expected to show proper identification when entering the facility.
RULES AND REGULATIONS
I agree to follow any Full Works rules or guidelines posted at the Studio or communicated by club staff. Studio may, in its sole discretion, modify its rules or policies without notice at any time. Club rules may vary by location.
DAMAGED, LOST OR STOLEN PROPERTY
I understand that the Studio is not responsible for any of my personal property that is damaged, lost or stolen while in or around the Studio location. I understand and agree that I am liable for all damage I cause to the equipment or physical infrastructure of the Studio facility and will reimburse the Studio for any damage caused.
LIABILITY FOR PROPERTY
The Studio is not liable to me for any personal property that is damaged, lost or stolen while on or around Studio premises including, but not limited to, a vehicle or its contents or any property left in a locker. If I cause any damage to the Studio, I will be liable to the Studio for the cost of repair or replacement.
I may not take unauthorized photos or videos anywhere in the Studio. I understand that the Studio uses unmonitored video surveillance and card usage is recorded, which both may be retained by the Studio for future use.
